It looks like the ITC staff is recommending the same conclusions as Ware and Grewal. We asked for more on some of the non-important claims, but for the key terms we won like "noncontrollable." It was not part of the staff's construction. Fairly logical stuff. No whoppers ... Same as Ware and Grewal, who were cited by the staff for virtually every term. I'm glad the ALJ decided to hold a Markman because the review process after the ALJ makes his formal ruling could be overturned, and given the potential financial impact, it is better for the ALJ to be very thorough.
