RESPONDENTS NINTENDO CO., LTD. AND NINTENDO OF AMERICA INC.’S TENTATIVE LIST OF WITNESSES TO BE CALLED AT THE HEARING
Pursuant to Order Nos. 7 and 15, Respondents Nintendo Co., Ltd. and Nintendo of
America Inc. (collectively, “Respondents” or “Nintendo”) tentatively identify the following
witnesses that may be called to testify at the hearing in the evidentiary hearing either live,
through witness statements, or by deposition, as Nintendo chooses or the Administrative Law
Judge permits. By listing a witness below, Nintendo is not representing that it will bring that
witness to the hearing to testify live.

and/or of the Office of Unfair Import Investigations, and also reserves the right to call rebuttal
witnesses who may not be listed herein. Nintendo reserves the right to call additional witnesses
to provide foundational testimony should any party contest the authenticity or admissibility of
any material proffered at the evidentiary hearing. Nintendo reserves the right to substitute one or
more additional witnesses should one of Nintendo’s designated witnesses become unavailable.
Additionally, as discovery is ongoing, Nintendo reserves the right to amend this list as
necessary based on further discovery and investigation.
