I do not believe that TPL lost its right to license the MMP. I believe TPL surrendered that right to PDS as a result of the Brown v TPL litigation. This had to do with the bench trial determination of how "gross proceeds" were to be defined as it related to Brown's 3.5 % of MMP "gross proceeds" TPL is oblidged to pay.
