Total agreement with you. If "uncontrollable" was not put forth as an issue, there would be no need for the judge to address it. However the other side having brought it up, he could not construe in such a way that does not answer the question. Hence the inclusion of language that provides clarity to both sides with respect to the question of being "uncontrollable."
