IMO, insufficient attention is being directed at the potential legal outcome at the ITC regarding Huawei & ZTE, two Chinese tele-communications and computer firms. Earlier this month, Huawei was the lead story on CBS "60 Minutes" program, followed by a companion expose in the New York Times a few days later. Additionally, vigorous testimony was provided by Congressional lawmakers warning of Huawei's economic and potentially, serious Chinese eavesdropping inroads into the U.S. Telecommunications industry. Soon thereafter, Huawei's U.S. representatives complained publicly about the undo attention and denied any wrong doing regarding corporate espionage. In totality, this has been a public relations disaster for Huawei, IMO.
The ITC does not operate in a bubble in Washington and is subject to the winds of public opinion, especially in an election year. Furthermore, Congressional lawmakers will make their voice heard when it comes to Chinese firms competing unfairly in the United States economy - Economic Nationalism.
The ITC is all about unfair international competition, and the harm it has caused in terms of U.S. employment and economic activity. They see the economic carnage wrought on the US mainland by foreign competitors stealing US hardware and software designs incorporating these inventions at a fraction of the price. US spends billions on R&D, while foreign competitors steal designs - see Samsung vs. Apple.
Coincidentally, the Federal Judge that oversaw the recent $1B Samsung vs. Apple case is presiding over our case at the Federal level. Additionally, ZTE issued a rather weak PR when first accused by TPL of infringement at the ITC level expressing a desire to "work together", paraphrasing to arrive at just, mutual beneficial outcome. lol
IMO, in light of the current political atmosphere in Washington and US economic landscape, I believe TPL can and will present a strong case of patent infringement to the ITC and the undue economic benefits which have accrued to Huawei & ZTE over the last several years. TPL riding the wave of US economic nationalism, could very well command a strong winning hand at the ITC, and prevent both firms from importing their products into the US quickly. Both firms seeing the writing on the wall and the bad PR environment which currently exists, may settle in the next few months for substantial amounts $>25M each gross.
