Those alleged infringers who are somehow involved with consumer products may be negotiating settlements that will hit the [holiday] quarter in which their sales/profits are cyclically higher and so have less of an effect on their P&L for the quarter.

Plus, someone's got to pay for the PTSC/PDS/TPL Holiday parties, bonuses, gift exchanges etc and possibly a pre-2013 strategic planning meeting in the Caymans.
