The ITC is definitely the hare whereas the No District CA is the tortoise. Within 2 months of its August 2011 ITC filing for Core Flash, TPL began to license some of these companies. Perhaps we will be just as lucky
Last March, TPL posted the following in a PR

TPL previously filed complaints with the ITC and in US District Court against 18 companies in August 2011. Eight of those companies have since purchased licenses. Five active respondents remain in the investigation. The remainder of the original respondents were either terminated based on findings of default or stipulated consent orders. Under the current schedule, trial commences in September 2012 and the target date for the completion of the investigation is February 2013.

The complaint was filed August 2011 case 337-TA-807. By March 28, information that I glanced at indicated that the following players were out on the basis of licenses or stipulated consent orders:

The following were found in default: Nextar, Win Accord ltd, Win Accord USA
