Apple v. Samsung Juror says Emails were "Most Damning"

"Ilagan said one of Samsung’s most telling actions was the emails its executives sent to each other, pointing out features on the iPhone they would like to incorporate into Samsung products. Further, Ilagan says he was unimpressed by Samsung’s reaction to questions presented to them on video. “I thought they were dodging the questions. They didn’t answer one of them. They didn’t help their cause,” Ilagan said."

I remember the same thing happened between TiVo and Dish. TiVo obtained internal emails where Dish executives admitted they copied TiVo's timewarp patent.

It's one thing to go in front of a jury of our peers, and show them pages and pages of technical reverse engineering documents to prove infringement, vs. providing internal email/memos from the opposition admitting they infringed. Just one of many reasons IMO we are most likely to see settlement as compared to trial, unless of course we have confiscated similar internal confessions. (:
