What scares me is the publically announced decisive Markman victory. Clearly, the Markman isn't over. Others here previously argued that the reason PTSC never PR'd the 1st claim construction order as a victory was because they didn't want to anger Judge Ware by claiming victory before a final decision was made.

What changed that would allow PTSC/TPL/Alliacense to be so bold with their announcement prior to a final decision? Are they confident of the outcome for reasons unknown to the rest of the world or ???
