I just got off the phone. Judge Ware's courtroom deputy said that Judge's chambers have been closed since last Wed. He will contact the Judge's law clerks this morning and ask:

1. Is there local rule that addresses a mandatory time frame for a Markman ruling

2. Is Judge Ware expected to rule before he retires? If not, who will rule?

3. Does the motion to strike before Special Master Tom Denver have anything to do with the delay in ruling?

He promised to call me back this afternoon. If and when I hear anything, I will report back.
