If you read that pacer closely, you wil see that we argue that Barco is trying to litigate the case thorugh the ICs. By asking for the degree of proof they are asking for, is essentially to prove infringement.

If our further revised IC s were not acceptable to the court, I think we may have heard something long ago. On the other hand, what if the ICs were now essentially proving infringement? Might the Special Master make that determination and tell Barco to settle by a certain date, afterwhich he will suggest that the defendants apply for SJ based on the ICs and supporting documentation?

Makes as much sense to me as some of the other speculatios.
