I was wondering whether Judge Ware might want his replacement in agreement with the constructions before he rules on the Markman. IMO, this poses some potential difficulty if the new judge needs to be educated and or disagrees with the constructions.

IMO, it is unlikely that judge Ware is going to be able to get this through to a jury result prior to retiring, so this may have complicated things. Just trying to understand what is taking so darn long and this could be a reasonable explantion.
