What worries me about a successful Markman is what incentive does PTSC/TPL have to increase fees? To date they are simply going after the low hanging fruit... the coffee money companies offer for us to go away. If our strategy is not to litigate then companies will continue to offer low ball amounts and PTSC/TPL will continue to take them regardless of a successful hearing. Why would they change their strategy?
