Just got off the phone with Flowers... He was nice enough to return my call/voice mail...
He too is disappointed in the MMP fees but given the marketplace and its view of patent licensers... it is what it is... until something changes... like a strong Markman ruling in our favor... Let's hope TPL's Claim Construction arguments were very convincing and we get that needed sentinel ruling
When I asked about the possible ASM Leckrone statement regarding the $350M total dollar amount the MMP has brought in.. He stated he didn't remember hearing that.. but that the total is 'over $300M' not $350M... So.. short of a potential DL senior moment at the ASM.. this Q is right in line with what would be expected (disappointingly so or not), again, short of a major strengthening occurance.. such as a Markman win... Hopefully with that victory we will see higher licensing dollar/infringement..
