I think that it was TPL who requested more time b/c Barco would not come forth with the materials TPL needed to do the work required. The SM said that Barco was required to present the materials and gave a deadline for the amendments---which would have been the 26th. It looks to me like Barco is throwing stuff at the wall now--WHEREAS, claims 7, 10, 14, and 16 of the ‘336 patent were inadvertently omitted from Barco’s Proposed Order (Dkt. 238-5) and Reply Brief (Dkt. 266);------again, they are omitting information that should have been included a long time ago. IMHO, TPL is standing tall in this matter by agreeing to amend the additional claims. They have 4 more days in which to get the job done, but I would wager that they are either well on their way to having it done or have it done already! Corrections are welcomed. GL, ads
