In other words, the PTO will not reexamine patent claims that previously were invalidated by a district court. In sum, only a final, non-appealable, ruling on invalidity is binding on the PTO.

Toxic - Thank you for posting this! It certainly adds a great deal of insight into the J3 'Resolution' we saw in Texas years ago and it's certainly something to keep in mind as we continue the fight in Northern California...
