Regarding your post, I would like to thank you for your kind words. I know I was not the only businessman at the meeting but I guess I am at the point in life or have always been that way (I went to college when we learned history, Econ 101 and more and left the classes on the history of Titanic (which is now being offered at UCSD and SanDiego State, but I digress) to others. We were of the age of the three R's not the politically correct. After a certain amount of time taking B.S. from someone (our ptsc board and Leckrones) I feel compelled to call them on it.
The board was not stunned by my questions or comments as they have heard from me before. They know I have no desire to be on the board and have no agenda other then to get to the truth and "know what I own", whether it is stock or any other asset. At my age it is hard to pull the wool over my eyes but it can be done but even if they could do it they have sang the same song for so long that it is a long time past that anybody should believe any of the four we heard from on Friday and should just believe in what they can see in the way of share price.
TPL must have really screwed up imo to have the largest market cap company in the world (depending on the day it could be Exxon Mobil), Apple, to have gotten a sweetheart deal and for it not being reported. Like I posted it is my opinion that when Stan, and I give him credit for asking about Apple though I wish he did not try to be so diplomatic in his approach yesterday, asked Lecky (the only nickname I have for the man I can post in open society) Lecky mumbled about some problems on their end and could not go into it and it ended there.
One of the items that has not been posted is that like the local shm three years ago there were two Elite (a local San Diego firm) security guards on duty in the room. Nice men one of whom was helpful to me in getting up and down. However they were there so that I knew that if I got to rowdy I would have been escorted out.
To directly answer your questions the board was in business attire. Nothing flashy. They certainly were friendly with each other and there was no dissension what so ever. In fact one of the reasons Cliff said he is still working at the company when I asked him to quit since he did not have faith in the company was that he was still there because of his fellow board members and a few other nonsensical reasons. He failed to mention that he would probably be collecting unemployment (but then he would have to be laid off so that option is out for him). Believe me he is not underpaid in the San Diego market as he claimed.
I do not know if you or if anyone else who reads this has ever read Atlas Shrugged by Ayn Rand but his comments and those of the rest of the boards reminds me of that book. The basic premise of her book and her philosophy in life (and I am not a Rand follower) is that "from each according to their ability to each according to their need" that is the way our country seems to be going and definitely imo was what our board was trying to tell us. Don't judge our compensation on what we do but what we need. Sounds a bit like D.C. where they feel that if you are successful you should pay your fair share, what ever that is and if it means you cannot create private sector jobs never fear the govt. will. Well imo ptsc is a publicly traded welfare company for the three board members.
You are right this is a penny stock and that is why I a few weeks ago and yes at the board meeting suggested that what the heck why not hire a marketing firm that specializes in pushing up penny stocks if only for a while. At least enough for some of our hurting shareholders to get out with some dollars.
Obviously, we should not be a penny stock or at the very least that should have ended when Woody and then Swartz were out of the picture. But the fact of the matter is that we are worth pennies per share.
It use to be thought that we could not move up as Swartz manipulated the stock to make a small fortune every quarter or so but I think he is long gone and if we had a partner other then the Leckrones and if we had as employees and a board that knew anything about how to run a company we would either be a multiple dollar per share stock, have been bought out or to be honest we may have taken someone to court instead of settling for pennies and have lost and maybe be in the dust heap of companies that had their spark and lost it or have hit the jack pot by wining in court and having the big guys line up for large settlements so as not to leave it to chance that a jury would hit them hard also.
But to go through 17 patent re exams and to be at 5 - 12 cents a share is a travesty imo and I would bet that some very negative things (trying to watch my words) could be found if we were really privy to openness as the board and Lecky said we were until I said great tell us and he and they backtracked.
Putting someone like Brian, or Larry or our man from across the pond Roy, or Ron of course on this board years ago would imo have us at a very different stage of life. We did have the best and maybe still do mousetrap that everybody needs it is just that somehow it wound up in the hands of some very small minded people who looked and still are looking out for themselves.
I still am of the opinion that if the Judge Ware acknowledges our position in a positive report (when asked why he felt we would win the Markham hearing, Lecky answered in one word, "Luck". Sorry had to add that as I was stunned by such a ridiculous answer to a serious question) and if TPL cannot arrive at a HUGE settlement figure then we should take them to court and let the chips fall where they may. At this point what do we have to lose.
Lastly and I am sorry I have gone on but this is something that I feel is important and really has never been addressed adequately lately.... Lecky and our Board hide their lack of openness to we shareholders regarding settlement fees (and even now we find out settlements) because they "do not want other companies to know what little they can pay to make us go away". This is a canard a patently false imo reason that they have gotten away with for way to long.
Every company that has infringed on the MMP has for the most part if not totally used it in chips that are not the same as any other. Apple chips are designed to run Apple hardware, HWP does not use the same chip as IBM, AMD does not have the same chip as Intel. I could go on but the fact is that all companies have maybe similar chips in use in their products as their competitors but I would bet that few if any are exactly the same. Plus, these are companies of different size etc...
To boot it should be noted that by saying things like early signers discounts and not going to court etc etc and law library banter amongst patent attorneys we or at least I can assume they all know what we have settled for and in fact probably the only people who do not know are we the owners of the company which is ironic as our erstwhile leader Cliff is not an owner of a single share and yet he knows. So bottom line I hope nobody if they agree in the least with what I have just written will accept the fact that TPL is keeping quiet so we can sneak up and get a huge settlement due to the fact a company has no idea what the "market will bear".
I just remembered after reviewing my notes when Lecky was asked if we are going after the mobile app businesses such as SnapDragon by Qualcomm he had no idea, (though that is my opinion it was obvious by his demeanor and stumbling) what a mobile app or mobile device market is. This is the man leading the company that is supposedly taking to task those companies that have infringed on our patents. I can only imagine who many companies we could add that are infringers if we look at the mobile device market. I do not remember who asked that question but it was a good one and thank you. Lecky was in over his head during a good part of the meeting and this was just one aspect to prove same.
Okay off to walk the dog and go to church and really pray for forgiveness as I know I have not been a charitable person the past few days.
