Are we asserting the 584 in this litigation? I've forgotten. If we are then the infringement contentions in relation to a favorable Markman will determine if the T3 infringes the MMP. If our infringement contentions have been tailored to the updated 584 patent via reexamination and the Markman result varies on the updated claims, it is certainly possible with a favorable Markman the 584 could be back in play for infringement against the T3. Obviously it wasn't in play at the time against the J3. There are a lot of patents and claims being disputed at the Markman. Hopefully we will 'win' a lot more than we 'lose'. Bah!
