I think I see the problem. You still do not understand what the discussion is about. The basis for my opinion is exactly what you state to be a logical assumption.

That is the whole reasoning behind my opinion. The basis for it. The litigants fully appreciate the signficance of that statement and the impact of the Special Master's report if there is no settlement.
