Well not on this board, but experts have testified at both the Js and Ts. Problem is there are other experts saying something different. Who does one believe?
IMO, everyone (including the experts) is waiting for elimination of all possibilities that any belief that a license is needed and decision to act on it could be made wrong by either the USPTO or the courts. Perhaps sufficient doubt exists that potential licensees are willing to pay more later than to pay early and be wrong? IMO, a successful closure of the Ts gets us to that point.
