laurie,

i am not attorney, but the MA is betwen PTSC and TPL, not moore. moore's issues are with TPL and his contract with them is the point of contention between moore and TPL, not PTSC. i am not sure we would come into the equation even if moore can prove that TPL violated the contract between moore and tpl.

if MMP licensing does not start producing then it would appear PTSC caved in and PTSC gained nothing from the settlement. I dont buy the argument that TPL is waiting for the Markman.....we walked that path with the J3, had a favorable Markmen, and PTSC and TPL chose to settle and not push the issue to a court settlement. Not sure why. But we know that the J3 agreement was supposedly a win for PTSC....and the victory brought nothing substantial to the treasury, just enormous litigation expenses that went straight into the pockets of TPL. Why was the J3 settlement secret? Was our case weak, even though we seemed to prevail in the Markman? Or did TPL get what it wanted and PTSC allowed it so the BOD could continue to draw outrageous compensation packages for just filling out the required SEC documents?

IMO, if PTSC does not allow the sharehholder to see the new and improved MA then the sharehholder probably got screwed.

lamberts post summed up the situation pretty well.
