No, I'm not confusing it as you say. The blurb I quoted is in respect to PDS, not PTSC. HOWEVER, so many here have tied PTSC's life to the MMP, and the MMP for PTSC all flows through PDS. Since we have COMPLETELY obligated ourselves to TPL through the PDS arrangement, the death of PDS, could well spell the death of PTSC. At the least, it will completely change how PTSC does business (makes me laugh to write that as while there needs to be a change, I don't think our current crew would begin to know what to do if there were no PDS).
Ultimately, we either better get TPL COMPLETELY OUT of the MMP mix and figure out an arrangement with Moore directly and SOON, or we better get an arrangement with Leckrone SOON that is fool proof, as we've PROVEN to be well stocked in the fool department so far, and there doesn't seem to be any changes coming soon in that regard. Either way, Leckrone seems to be willing to burn all the time in the world to push PTSC to the brink, which in turn makes Gloria's assertion that TPL is "insolvent" very questionable, inasmuch as Leckrone = TPL.
I'd suggest that either Leckrone is a desparate crazed lunatic (which he could well be), or he's been primed for this fight stashing away the war chest he needs to ride it out, and has fashioned agreements that he's relying on to take years in court to untangle. His business philosophy is so counterproductive, IMO, UNLESS of course you're dealing with weak, easily manipulated adversaries, and your goal is to fleece them on your way to gaining full control AND ownership of something that you don't have that type of right to. This appears to describe the last 6years of the TPL / Moore & PTSC relationships.
As for the Apple license, I simply suggest you do some research into the company, its activities, and ongoing legal matters. Read more than just the Agoracom board. You can learn a lot. What I've learned from doing that, unfortunately, has proven mine and many others' last 4 years of posting as nearly spot on correct, despite those who defend the actions of our BOD and company. I'd suggest that while the company won't reveal the licensee's names in PR's or filings, you can gather a wealth of information from other documents that are available to the public with some work, and you can piece together the missing links.
That being said, what would you EXPECT an Apple license to bring in to PDS? Do you think that the $11.1 M that PDS recieved for the last 12 or more licenses is adequate / acceptable, knowing that Arcelik, Dresser, Cummins, and Stryker are among those 12 if Apple is as well? If not, why do you think it's so low? How does PTSC remedy the situation if the Apple cow is out of the barn already? Short of court orders stopping them, and and agreement with Moore to not go it alone, how does PTSC stop TPL, or Moore for that matter, from continuing to license the MMP despite PTSC's protestations / concerns to the contrary.
Considering LICENSES ARE BEING SIGNED STILL, how does PTSC turn the license proceeds into cash to their bottom line, instead of TPL and the "3rd parties" they have working on the MMP "project" getting 95% of the license revenue as they did this past year?
We supposedly are "finally playing hardball with TPL", yet the MMP "earned" $11.1M in FY2011, yet only $1.2M of it made it to PDS' bottom line, and of that, only $800k was distributed to PTSC (more than 50% presumably because part of it was to settle TPL's note due).
Sounds to me more like TPL is playing hard ball with us!.
