I'm interested to know why PTSC hasn't named Robert Neilson in the case, or why he hasn't been sued directly. Based on the allegations in the amended complaint you summarized, it sure seems as though the foul play by TPL began long before the April license referenced here.
As we know, Nielson went from an "independent" (lol) advisor to TPL when he was appointed to the PDS Management Committee as the "independent member" to a full fledged TPL EMPLOYEE, which should have immedieately disqualified him as the independent member. He was beholden to Leckrone, and had the ability to damage PTSC's interests at worst through his approval of license deals, expenses submitted, and strategies, by being the tie-breaker in any votes, and at best he was derilict in his duties if he allowed these type of allegations to go on without calling it out to PTSC.
I find it very difficult to swallow that he didn't know what TPL was doing, so he either went along with the "fraud" that PTSC alleges, or he told CJ and CJ disregarded it.
It would be funny if the situation wasn't so pathetic, that he "coincidentally" beat cheeks out of TPL's employment ranks right when the whole lawsuit timing happened as I noted in this post back on April 27, 2010.

Something tells me Nielson was covering his backside by leaving, or finally decided he couldn't cover up anymore for Leckrone and made a fuss and thus got fired. Either way, it implies that he hurt PTSC through his actions on the management committee, and if so, IMO, PTSC should be going after him as well. At the least, he better be singing on PTSC's behalf!
