In this context, your estimate of legal fees "per case" may be light, since, by my recollection (corrections please), Roger Cook's firm was paid some $17 million in hourly fees for the J3 litigation. Of course, that is why most patent infringement cases are handled on a contingency fee basis --- the fees are much bigger in the end if large settlements or judgments are obtained, but there is less of a motivation for the plaintiff law firm to "churn" the billable hours and then settle for relative nuisance value

I thought that Cook's fees were in the 17 million range which is why I purposely chose $5 million to show that, with what might seem like a huge win at $200 million, in fact wouldn't go very far. If most patent infringement cases are handled on a contingency basis, is it correct to assume that Cook's $17 million was his contingency fee? If it was, then based on the money reported by PTSC, what percentage did Cook get? As discussed in prior posts it is legitimate for an attorney (i.e. Leckrone) to get a kickback from other attorneys....since PDS has always been generous in its decisions to pay Leckrone for his participation in various legal matters....seems like he may have/may still be getting the lion's share of every deal.

Also, is PTSC now using attorneys on a contingency basis re: (Acer/Barco/HTC) and if not, why not?
