what impact does it have on the claim of non-infringment?..it deals with the issue of non-validity and burden of proof associated thereto..correct?
Do not our opposing parties make the claim that their products don't infringe on the patents? While I understand that the ruling is postivie, it does not get around this hurdle. Who has the burden of proof in this regard (where TPL and their reverse engineering standards are of import)?
Don't get me wrong. I applaud the verdict. I am just looking at the other arguments that our opposing parties employ.
