Risk Factors

In every SEC filing (quarterly and annual reports) there is always the standard language about risk factors:
One such repetitive implied risk has been that PTSC has relied for the most part, on revenues generated from the licensing of the MMP and that such licensing may be reduced or cease to occur in the future.
This is no longer a possibility but a reality. Licensing has pretty much stopped.
In 2007 we saw 21 licenses announced and the only real spike in shareprice (.8) was in December when the announcement about the J3 settlement came out.
In 2008 we saw 19 licenses with the share price around $.56 at the beginning of the year and around $.14 at the end of that year
In 2009 we saw 12 licenses and 2010 there have been 5 including Dressler (but not including the mystery license)
We have seen a steady decline in licensing activity long before the suit against TPL in April 2010. Why is this? First it was the Markman that was going to change things, then the settlement with the J3, then the re-exam, then another re-exam, then waiting on a request for a re-exam....(not to mention litigation with Barco, Acer, etc).
What I don't understand and perhaps someone with a legal mind can explain this to me is: If PTSC depends primarily on licensing fees to survive and there is a restraining order preventing TPL from licensing activities, why wouldn't PTSC be allowed to negotiate licenses on it's own if it meant the survival of the company?
I'm afraid that as long as there are alleged infringers and continued litigation against them, coupled with an occasional re-exam request, we may have seen the best in licensing already.
Perhaps we shouldn't cling to those "patents on water" without strapping on some JC water walkers first.
We are in starvation mode and the BoD needs to be more frugal...eliminate their salaries, sell PDSG, and perhaps even sell the company. As I have said before, personally, I hang in there for the return OF my investment. Perhaps instead of looking to acquire, our Bod should be looking to be acquired.
Just one person's opinion. Like Pete, I don't hide behind a fake picture, nor do I have a hidden agenda. Just a person like you who believed in the dream but finally woke up to find a mess that needs to be cleaned up NOW.
