While others are preoccupied with the ongoing PTSC/TPL/DM dispute and its inherent ramifications, let's not lose sight of the significance of the '336 re-exam victory. The '336 is the bread & butter, chief revenue producer at present and for the foreseeable future IMO, current legal dispute between the parties notwithstanding. Without the '336, PTSC is a shell.
I believe the significance of the latest '336 re-exam rejection is under reported. The PTO dutifully accepted the request for re-exam, assigned it to a new examiner, who researched the voluminous brief from the requestor, (When is a lawyer brief not voluminous??..LOL), and came to the conclusion the request was invalid. Another one bites the dust! What a beautiful thing...Terrific news!
Once again, the '336 has withstood a legal challenge to its validity, further strengthening the patent. Another significant victory IMO. Every '336 patent challenge has been turned away to date. As time goes by and each request granted and rejected, we grow stronger and more prospective licensees realize delay and legal costs are futile, they will likely agree to a license sooner. They will be assimilated !!!... Added to the growing constellation of planets circling the '336 Sun in the PTSC Universe !!!..Yes, we are the BORG, resistance is futile...
Henneman has done a great job with the PTO and should be properly compensated for his contributions to date and hopefully in the future. I have full confidence in his abilities. He is a great asset !!...Virt
