"This attorney should advise us as to whether or not a lawsuit against the company/BoD is the appropriate action or....????"
My question as stated above:
What exactly is your accusation against PTSC?
Is it
1. that you invested too much money at the wrong time in a high gambling chance? (I do not use the word 'investment')
2. that you are frustrated that the most important official entity for intellectual property (USPTO) is inefficient, buerocratic and maybe influenced/in the hands by/of lobbys?
3. that you can't accept the legal implications of lawsuits in general and IP licensing activities in special which force the parties to hide their agreements?
4. that you had expected the "umbrella business plan" with M&A activities to result in at least one new Google and not three or four failures (think about these failures if PTSC would have been able to increase its cash positions and therefore would have been able to support Avot & Cie. longer).
5. that you are disappointed that partnerships (TPL/CM/PTSC) get damaged or maybe destroyed?
If one of these or all of these points apply then you're in good company with me (in certain aspects of the above said) and many other shareholders - but where's the reason for a lawsuit (adding another lawsuit)? Against the former CEOs? Against the BoD?
I cannot see your attempts other than Kamikaze action - minimizing and at least destroying the chance of your investment's recovery in the short, middle and long term.
