Milestone re 4.99% converstion cap

Is it possible that the purchasers were acting in concert or as a group with respect to circumventing the 4.99% (which was changed to 9.99%)? There are so many investors mentioned in various PTSC SEC filings, could it be possible that Eric Swartz is involved in more than one of those investor groups? If your answer is yes to both questions, what then would you suggest would be the best course of action?
