I believe that the BoD will have given full consideration to all possible options, including working with or without Alliacense, in filing for declaratory relief, over specific contractual disagreements.

No matter how outlandish suggestions are, be they negative or positive, reasoned debate will usually give rise to a consensus with which to go forward.
