Well explained, and logical, Option #1 is the answer.

My guess is that somone somewhere within the TPL legal team was tasked to determine (probably by some type of scientific approximation) exactly how many chip units that $20M represents, That would be the figure used as an approximate baseline charge to other infringers.

IMHO, TPL should be realisitic that since this is not like a utility company charging homeowners (where we get the bill, we HAVE to pay the dollar amount), the assumption is that negotiation will take place once the infringer gets the bill. I would have to believe that past charges would get negotiated downward from the base and future fees would be minimal. Makes no sense to charge a ``past due`` figure to your infringer that would drive them out of business...after all, you still want the future income stream.

Given this reasoning, the incremental PPS goals for TPL incentives represent reachable figures, with the last price being a stretch.

Even with my opinion, we may see enough momentum from market forces, allowing for an opportunity beyond the max goal point. But I suspect it will be fleeting, so Jack be nimble, Jack be quick....
