IMO, PTSC owns at least half of all reverse engineering and data generated by Alliacense to date as pertains to the MMP. The contracts between PDS and TPL and Alliacense would essentially IMO be "cost-type" contracts (I would think they are NOT fixed-price-type contracts due to the nature of the effort and inability to bid price in advance for a product that may or may not be delivered). In such contracts, typically any assets generated by funded performance are delivered/owned by the funding entity at the moment they are generated. Even the tools and WIP/raw materials in asset generation are so owned. In this case, at least half owned.
As I suggested in an earlier post, disposition of MMP-related assets (and possibly Alliacense itself) would probably be (have to be) a component of any resolution of the instant dispute between PTSC and TPL (assuming things go south). So yes, it could take a while, but not years IMO. Weeks-months.
I have to say, if you think this whole thing through, unfortunately having to apply logic that doesn't necessarily come into play, this whole thing SHOULD work itself out with PTSC having a great deal more control over PDS (and Alliacense) - the acquiesence of TPL. If TPL (Lecky) doesn't do this, what is he faced with? Looking just at what little we KNOW, does it look like Lecky/TPL has any chance of prevailing? I mean really....
IMO, this whole thing takes us back to the same old thing. The PTO. The recerts. The only thing that makes any sense in all the Lecky/TPL debackles is that it's all about buying time and staying afloat with no resources (and even this license announced by Alliacense today.....how much? Do you really think it's in the millions? I'm thinking more like a couple-few hundred thousand. Hardly makes a dent.). I strongly suspect that Lecky, if thinking rationally at all, is thinking that all he has to do is hold out for a recert, resume "productive" licensing, and most of his biggest problems go away (pay off Moore, pay back loans from PTSC, pay Moore/PTSC all disputed claims for accounting errors) and he's again on his way to the promised land. But perhaps with less control over PDS.
All that has to happen is for Lecky's hunger to overwhelm his arrogance. I'm thinking he's mighty hungry. And of course, the PTO has to come through.
BTW, in light of the above, do you think Lecky has stopped funding Henneman (or that there isn't some sort of arrangement)? I would think Henneman is covered in welts from being hit with a cattle prod by Lecky.
