First thing this morning I received a reply from Bahr (Robert W. Bahr, Senior Patent Counsel, Office of the Deputy Commissioner for Patent Examination Policy) advising that he will forward our concerns [of the prior (Opty's) email to the Director] to "the USPTO officials who oversee patent reexamination". This after thanking me for the input. The email turn-around was less than 24 hours.

The bad news is that he did not advise of a POC in that office, so there is no practical possibility of follow-up/further inquiries.

The good news is that our concerns (the handling of the '148, and more the '336) are being forwarded to exactly the right people to act on our concerns. Further, they are receiving the "prompt" for action from an "on high" PTO official and our concerns are IMO significant (non-compliance with statutory instruction). Thus, IMO the probability of getting immediate attention is greatly enhanced.
