The strength of the German patent is in the fact that the onus is on German companies, and or companies that operate in Germany, to ensure that they are not infringing it, which probably gave rise to the DT validity challenge.

I don't believe that any discussion on the German patent has been wasted rather it begs the question as to why there have been so few German licensees to date. There could be many who have contacted Alliacense subsequent to the German validity decision negotiating a mutually acceptable fee, with Leica being the first to reach agreement.

The European Patent brings them to the table (or face potential "willful infringement" liability - see my prior posts round the time of the announcement) and the license is for the total MMP Portfolio.
