sel inthe barco case but this is what I was told today by various members(calender clerks,docket clerks and court reporter) of the Northern District of California Court. Last friday was a case management conference. A motion to dismiss was entered. Judge Fogel did hear the motion to dismiss but did not and has not given an order i.e., ruled on the motion. The phrase was used " an adversary motion was argued". Lastly, I was told emphatically that no settlement had been reached. There was no harm in my calling the court as I am a member of the public and the proceedings are a matter of public record even though the minutes are not yet available. So, for those wondering, I did not ruffle any feathers. Finally, I had to check this out because the lawyer switch thing just did not convince me. There simply would have been more volume, probably just from the spectators who witnessed any evidence of settlement. good luck
