One has to presume that this expiration of a patent while being reexamined doesn't happen all that often. And in the handful of cases that it does occur, how often does the patent owner conveniently have court claim constructions to use to defend claims? Might HTC and Acer trial lawyers be scrambling to understand the rammifications of what Henneman just did?

Henneman may have just pulled a rabbit out of the hat. I'm hoping it surpised everyone, and puts dynamics of settlement negoitiations in a different light. It should IMHO.
