But, unfortunately the strategy doesn't seem to be working all that well. The infringers probably call each other up and state how much they pay. NDA's or not how would you prove it. They (T3, J3, and next in line) all probably have a war room set-up, sharing legal fees, notes, documents, and all their dirty little secrets. Since the Fujitsu deal ( Feb. 2006-what a coincidence ?) no one really has had to pay that much, not what they should anyway ( Sony comes to mind).
