From Websters dictionary:Modified; 1) to change partially in character. (I don't believe the character has been changed) 2) to limit slightly (I believe the amendments only clarify not limit) 3) to limit in meaning (I do not believe the meaning of the patent changed in any way.
Which one of the above meanings do you assign to the word modified? <The question is has the 336 been modified to the point where past infringment can not be claimed?>Exactly the point that I was trying to highlight. The word modified has the presumption that it has changed in a meaningful way. Amended is a preferable term until we know differently.
