Think about it. From when the PTO saga ends forward, what infringer is going to want to go the litigation route, where their only remaining avenue of escape is to try and prove their products never infringed. Good luck with THAT.
What makes you believe there is an end to the PTO saga? I'm not convinced there is an end any more to this process.
Also in light of our lawyer Cook's inability to answer questions by judge Ward during the Markman hearing and knowing that these huge corporations will have the best legal minds working for them, just what makes you think that these huge corporations don't think they can win in litigation against the legal minds TPL has even if the PTO has blessed the patents?
Does this shine a light on how sweet our position is about to be IMO? How there may be "waves" of licensees? How the rewards will be much greater?
Judging by the markets reaction would you conclude that PTSC's position isn't so sweet or do you think we are just that much smarter than other investors out there? I ask this question because right now I don't feel smarter.
Do you think the SP level is due to the latest 336 patent re-examination by the PTO? Or is it because TPL's bark is much worse than it's bite and to date there is no evidence that the license amounts have in fact gone up and that hundreds of companies have returned to negotiations? Or is it because of the soap opera that continues to follow PTSC and TPL and Moore?
I'm just trying to wrap my brain around why the MMP can be so special in light of its history and who is in control of it.
