I think you are misintrepreting what Moore is saying,

"Patriot thinks an ownership dispute might affect the '336 patent re-examination. But the dispute exists whether I post it or not. And surely the validity of a patent is independent of who owns it."

He is saying that PTSC is wrong. The dispute is about payments owed and ownership. Payments owed by Lecky to Moore have nothing to do with PTSC. And Moore says here that ownership has nothing to do with patent validity (the re-exam).
