I believe public view would only be when published. My point however is that if terminated, and a reexam cert issued, (which the patent owner can use as a defense against any new SNQ) why would the USPTO want to keep is a secret from the public at large? With the issuance of the reexam certificate, the patent owner knows, the USPTO knows and the 3rd party requester knows. Makes no sense at all to keep it from everyone else. And I believe we are both of the opinion that publishing is simply a formality.
