I'm thinking about the next "event" known to be headed our way, which would appear to be the publication of the re-cert of the '336 in the official PTO Gazette. If I understand correctly, the Gazette is a monthly (weekly?) publication that is issued on a Tuesday. Based on the date of the NIRC, and the 90 days between NIRC and publication in the Gazette, it appears the Gazette to be issued on 12/15/09 is the one we're looking for. If this is a weekly publication, is there any possibility of it coming out on the 8th (this coming Tuesday - a "close enough" scenario)? In any case, we should see the '336 in the Gazette as "re-certified" (with amendments) within the next 11-12 days. I'm currently of the opinion that this event should boost the PPS.
Having said that, I wonder about the possibility/probability of something happening re: the current/new/(bogus) re-exam of the '336 where the effort would be put to rest in light of the content of the '336 NIRC/file data, and this end to the effort being announced prior to or in concert with the publication of the re-cert in the Gazette. Would the PTO/examiner have a compulsion to take such action to just put this thing to bed and bring some harmony to the whole situation?
Please advise (anyone with a clue) re: the first para above, and comment on the second para as appropriate.
