Bad News is that we apparently are going to have to re-argue stuff that has already been argued. At least that is the way it looks to me.
As an example, in the present office action claim 1 is anticipated by Transputer T1414 data sheet, May 948, MacGregor MC68020, and Koopman.
This is a quote from the office action of 4/8/09 in reexam 90/009389 page 8 of 17.
"Thus with respect to claim 1, the above noted references of May, McGregor and Koopman are not seen to raise a substantial new question of patentability as to claim 1 of the 749 patent."
The T1414 was argued as a result of a 7/24/09 office action in 90/010520.
Good news is that at least we are familiar with the references, and have already successfully argued them. Cut and paste from prior arguments? I do hope we see some kind of official protest lodged against this examiner.
