Been out of pocket. Some thoughts re the latest OA on the 749.
Ok, we have 3 separate reexams, now merged. It would seem to me that it would be simplier/more efficient if the examiner first considered each reexam response individually before merging. Wouldn't it get quite confusing if there were separate issues in each of the three reexams that remained to be addressed in this last OA?
The 90/009034 response was back on May 4th. The 90/009389 response was back on June 8th. And the 90/010520 response was back Sept 24th, the same day of the merged reexams.
I'm thinking that the speed with with the examiner merged, might mean that there were no issues reamining on the two earlier responses. Examiners thinking was any issue would necessarily have to come from the 9/24 response. So a 9/24 merge w/o even seeing the 9/24 response does not present any difficulty for him. Hopefully there is some logic in the above thinking.
