No doubt that the opposition is looking for a J3 type business resolution. No matter what the rationale for the J3 settlement, can we afford another? While the last settlement did provide us with some post settlement licenses, I don't think that will happen again, because of the loss of credibility when the numbers became known.

So, IMHO, if there is any settlement, it would necessarily have to be decent from our perspective. We have nothing to gain otherwise. Unless it is simply to keep the lights on which, no doubt, is the oppositions hope. I really do not think the oppisition expects to defeat the MMP at this late stage of the reexam game. Hence, delay is the objective.

Given the merry-go-round that is the USPTO, we probably would like to get to a Markman hearing asap.
