We do have the 148 and 749 on the front burner. Responses to OAs are in the hands of the examiner and we know the examiner is presently working on both reexams based on recent postings that various IDSs have been considered. While the new 336 reexam is a let down, we could get whip lash should one or both of those get a NIRC in the coming days. While many here feel the 336 is the critical patent, IMHO the 148 is equal, if not of greater, importance. And from the aspect of potential litigation settlement, I think the 148 would serve that purpose just as well as the 336. Other opinions welcomed.
