The reexam request on the 584 that was denied is from the same party requesting reexam of the 336. It will be interesting to read the basis for the 584 reexam rejection (Not on IFW yet) because there is similarity between the 584 and 336 requests.
Both rely on the PTO accepting purported patent owner statements made during licensing talks. This is something which the PTO does not have to do, and is the basis for the prior art validity. If that is the rationale for rejecting the 584 reexam request, that should almost guarantee that the 336 reexam request will also be rejected. IMHO
