Message: OK..so I'm still in the corner with the delusional group regarding the MOU

When was the last time PTSC disclosed the dollar value of a new licensing agreement? The company has advised that they regard income from licensing as a routine event and not a material event. Any income resulting from an MOU would presumeably be similarly categorized. The only way I could see it being considered "material" is if the dollar value were uncommonly extraordinary.

As to your timing questions, see some of my recent posts - and event must occur to trigger the MOU, and then certain actions would have to be performed, most likely, before there is a "result".

Don't bother looking to defendants' financial reporting - it would be captured under "legal expense" most likely, bundled with any other legal expenses incurred during the period. Our financials wouldn't explicitly identify monies received in a descrete fashion (by "donor") either, but would be bundled as well.

Think of it this way - you typically don't apply NDAs and methods of secrecy to things you expect to disclose anyway. There are many exceptions to this (e.g., NDAs signed by parties to a negotiation knowing full well that IF the negotiations result in a contract, the parties to that awarded contract will likely be disclosed), but in this context it would be highly unlikely IMO.

FWIW,

SGE
