Others have referred to license payments made to us by infringers to be "nuisance payments" with the theory that payments to us are a drop in bucket versus revenues, etc. and no problem for certain companies to pay versus litigation. While the analysis with regard to the cost of litigation may be true, even the big boys would be reluctant to give up a million here or there..why?..earnings are tight..those monies could be the tipping point about making or breaking a particular quarter..
Some may even be putting off signing until next quarter such that they may be able to make their quarter - "nuisance payments" no such animal in the current environment IMO. Everyone is being tight with money these days..even the big boys..and the big boys are not afraid to litigate. Where is does become problematic in my view is where they get smart and start acting in consort to undermine our efforts - some of which has been going on and will continue to go on in the future. Hopefully, those days will be behind us now..or in the near future.
