OK, I think I understand what you are referring to now.
To clarify, my 90 day reference that I posted to d2006 yesterday and previously applies to when the amended patent will be officially posted in the USPTO's Official Gazette newsletter, not to when the recert letter would be sent to the patent owner. Actually, that letter to the patent owner was sent when it was posted on the USPTO transaction history.
My hope was, and my point was, that it is typical for companies to issue a PR when the recert letter is received, not 90 days later when it appears in the Official Gazette. If TPL/PTSC were to NOT issue the PR, to me that would have been a concern. That they did is a very positive reinforcement, IMO, and bodes well for the strength of the '336.
